Litigation is the process by which disputes are resolved by a trier of fact such as a Judge, a Mediator or an Arbitrator. Generally, litigation involves having a dispute heard in State or Federal court, but may also include Mediation or Arbitration.
Illinois law favors non-litigated resolution of disputes, and where possible favors Mediation or Arbitration over full-blown action in Court. The reason is simple: too many disputes that coud be resolved by the parties themselves end up in Court. And the result is that the Courts are virtually clogged with disputes – whether business to business, person to person, or a combination of both.
