Plainfield Bankruptcy

Plainfield, a southwest suburb of Chicago located in Will County, is one of the fastest growing communities in the nation, home to nearly 40,000 people as well as several of the country's largest warehousing, storage, and distribution businesses.

M. Hedayat & Associates, PC has counseled consumers and small businesses in the Plainfield community about bankruptcy and reorganization for nearly 20 years; including Chapter 7, 13, and 11 cases. While Bankruptcy is often seen as the end of an endeavor or sign of failure by members of the public, the truth is that more often than not it is really just a stepping stone to a new phase of life, of business, and of opportunity. The firm has handled bankruptcy cases and adversary litigation in the Bankruptcy Court for the Northern District of Illinois; Eastern Division (Chicago) and Western Division (Rockford). And we often take on complex, challenging cases that other Attorneys cannot, or will not, tackle.

M. Hedayat & Associates is proud to have played a pivotal role in the reorganization, and where necessary the successful liquidation, of businesses based in Plainfield: from professional practices to construction companies. During the turbulent first decade of the new millennium, M. Hedayat & Associates was there for businesses, professionals, and working families: we have offered workshops, community outreach, and seminars to help homeowners and businesses to cope with what sometimes seems like crippling economic hardship.

Examples of Recent Cases in Plainfield
  • M. Hedayat & Associates handles bankruptcy cases for people from all walks of life including entrepreneurs, working families, even executives in Fortune 500 companies. Last year we represented an extended family in which parents, 3 children, and grandparents lived under one roof. Both parents worked, so the family had an income that was higher than the Illinois median. But sudden changes in the economy, medical expenses, and the high cost of both child-care and elder-care, threw the family finances into chaos. M. Hedayat & Associates was able to secure a fresh start in Chapter 7 for our clients despite their high income. And thanks to quick thinking and persistence we were able to deflect an attempt by the U.S. Trustee to end the case altogether.
  • M. Hedayat & Associates frequently represents both small business and the entrepreneurs behind them. A few years ago the firm represented a warehousing company in Chapter 7. That company had been losing business due to just-in-time delivery, higher fuel costs that affected logistics expenses, and the fact that it lacked a rail siding. In addition, the owner had guaranteed several lines of credit using the equity in his house. After securing a Chapter 7 finding of no assets for the company, our office got to work putting together a plan of reorganization for the owner of the business. The firm was able to work out a more relaxed repayment schedule on the personal side (Chapter 13) while taking the business out of the equation altogether and delivering limited value to creditors through the sale of inventory and finished product on hand (Chapter 7).
